They include common parts of buildings containing flats, amongst others and also any yard, garden, outhouses and appurtenances belonging to or usually enjoyed there with. Similar to the 1985 Act etc. I wouldn't have any qualms about dealing with a patio area or a fence associated with a dwelling on this basis, depending of course on the deficiency identified and the associated hazard score. I was just wondering if landlord responsibilities under HHSRS as laid out in annex A of the enforcement guidance were the same as section 11 of landlord and tenant act (1985)with the addition of food safety and ventilation. Paragraph 2.36 of the enforcement guidance refers to previous parliamentary and judicial scrutiny of landlord responsibilities. I only ask this question in regard to rear gardens as fencing and patio paving is normally not part of a landlord repairing responsibilities unless expressly implied in a tenancy agreement. So if paving and fencing are not part of landlords repairing responsibilities can we enforce HHSRS on those items. HHSRS will survey HMOs with common areas differently to the norm; but other HMOs are treated like normal domestic properties. Some LAs are trying to argue that under HHSRS enforcement ALL HMOs should have commercial level fire 'works' put in, despite the fire order exemption. They have to consult the fire service and the fire service will obviously say - we have nothing to say, it is a domestic property!

Has anyone made arrangements with their Fire Service in preparation for the changes?

I managed to obtain early payment of my pension and since then, away from the dreadful workplace in which I was placed, my health has recovered - I have undertaken casual EH work for a number of non LA clients - esp. pollution - noise - planning issues. Having recently been informed I am able to work for any other LA as an EHO, not made clear when I was awarded pension, I have applied for district EHO jobs. I am getting nowhere - how do you explain to a possible employer that your health was wrecked at your last EH [LA]job, you were pensioned off, and health now fully restored you are anxious to get back in to EHO work? 700 vacancies?
